Below are listed a number of questions we are frequently asked. If you have other questions, please do not hesitate to contact us with any questions you may have relating to asbestos related illness.

Can I make a claim?

The usual criteria for making a claim are:
a)      You have come into contact with asbestos
b)      You have been diagnosed with an asbestos-related condition
c)      You are experiencing symptoms as a result of exposure to asbestos
We will obviously need to discuss your circumstances with you but if you satisfy these criteria, we may be able to bring a claim for you.

Are you a Claims Company?

No we are not.  We are a small team of specialist solicitors with extensive experience in handling asbestos claims.

What if my employer is no longer trading?

Let us worry about this.  It will not be a problem if we can trace the company’s insurers at the time you worked for them.
We have ways and means of trying to trace down insurers although this is often one of the biggest stumbling blocks to potential claims.

I am struggling to remember the dates!

We can help with this.  We can obtain your employment history from the Inland Revenue who keep records dating back to 1961.  The exact dates do not necessarily need to be known.

Are there any time limits?

Ordinarily, a person has three years from the date upon which they first become aware that they have asbestos-related problems to make a claim.  This time limit can be extended if there are good reasons for this.

I have problems with my chest but how do I know if this has been caused by asbestos?

If you have chest problems and have worked with asbestos, the best thing we can recommend to you first of all is to have a chat to your GP.  He or she should refer you to a chest specialist who will take a history from you and x-ray your chest.  This should give a good indication of whether your problems are asbestos-related.

Is there a lot of form-filling involved?

There are some forms which we need you to sign but not too many.  We try and get these all signed at the start and once you have done so, we can then do the rest for you.

Will I get to meet my solicitor?

We try and meet as many of our clients as we can although we can do a lot of our work over the telephone.  We will do our best to come and see you, wherever possible.

How long will it take?

A typical asbestos claim will take between 9 and 12 months to conclude from first contacting us.

How much will I get?

This is a very difficult question.  We will discuss with you the likely value of your claim but the reality is that the more seriously ill you are, the more your claim should be worth.  Please have a look at some of our previous cases as a basic guide.

Will I have to see a medical expert?

In a lot of cases, you will have to see a medical specialist.  In some cases, we can obtain a report from a medical expert about your condition by the specialist reviewing your medical records, x-rays and witness statement.  Whenever we arrange a medical appointment, we always try and make this as convenient as possible for you and with a specialist who is local to you.

Is your service totally free?

Yes.  If we win your case, the Defendant’s insurers pay our costs in addition to paying your compensation and if we do not win, we do not charge. You have our 100% guarantee of this.

Who pays for things like medical fees?

These can be covered by insurance which we can take out on your behalf at no expense to you.  As with our own costs, we would never look to you for payment of fees.

Do you take anything out of my compensation?

Can I apply for benefits?

If you are suffering from an asbestos-related condition, you may well be entitled to recover benefits.  We will be happy to discuss with you the possibility of applying for benefits and we will give you all of the information which you require.
