Entitlement to Benefits

Your entitlement to benefits will depend upon your own personal circumstances. If you have an asbestos-related condition, you should contact your local benefits office to see if you are entitled to any or all of the following benefits:-

  • Industrial Injuries Disablement Benefit
  • Attendance Allowance
  • Incapacity Benefit
  • Disability Living Allowance
  • Income Support or Pension Credit
  • Carers Allowance

If we are successful in recovering compensation for you, the Defendants have to repay to the Government any benefits which you have received as a result of your condition. Some or all of these benefits, dependent upon your circumstances, can be deducted by the Defendants from your compensation award. This will depend upon what we have claimed for on your behalf.

By way of example, if we recover £50,000 for you and this includes £20,000 to reflect the fact that you are no longer able to work as a result of your condition. If you have received £5,000 Industrial Injuries Disablement Benefit, the Defendants would deduct this from your compensation award in order to repay it to the Government. You would therefore receive £45,000 and the Defendants would re-pay the £5,000 to the Government.
