Pneumoconiosis (Workers Compensation) Act 1979

This act was originally intended to compensate people who had asbestos-related problems in particular asbestosis and mesothelioma but were unable to trace the employers who exposed them to asbestos. The scope of the Act has now been widened.

If you are entitled to payment under the Act, this will be paid on a sliding scale according to your age and the extent of your disability.

If we subsequently recover compensation for you, the Defendants have to repay to the Government any money which you have received under this Act. They are entitled to deduct this from your compensation award. If for example, you recovered £5,000 under the Act and we subsequently recovered £50,000 by way of compensation for you, the Defendants would repay the £5,000 to the Government and pay you the balance of £45,000.
